Legislative Mandate

R.S. 40:1646

Louisiana Revised Statute R.S. 40:1646 establishes the regulatory authority of the Fire Marshal over the inspections and enforcement of these provisions and requires building owners to cause inspections of regulated conveyance devices.

Annual Inspection Required

Effective January 1, 2026, the owner of any building containing a conveyance device shall cause at a minimum an annual inspection and certification to be physically witnessed by an inspector licensed by the fire marshal

Five Year Load Test

This provision only applies to electric traction elevators.

Effective July 1, 2028, the owner of a building shall cause, at a minimum, a full-load safety test of the conveyance device in five-year intervals.

Exceptions

The requirements of this provision do not apply to the following:

  • The owner of a building with two stories occupied by a single tenant wherein employees of the tenant are regularly inside of the building. The building described shall not be construed to include a one-or two-family dwelling as defined in La. R.S.40:1573
  • Private outdoor recreational structures pursuant to La. R.S. 40:1730.30
